These Terms of Use (these "Terms") govern access to and use of the website located at https://jacksonvillelegalteam.com and any related pages, content, features, forms, communications, and services made available through that website (collectively, the "Site"). The Site is owned and operated by Law Office of Carl G. Hawkins, PLLC (the "Firm", "we", "us", or "our"). By accessing or using the Site, you accept and agree to be bound by these Terms and our Privacy Policy and Referral Disclosure. If you do not agree to these Terms, do not use the Site. Your access to or use of the Site constitutes your agreement to these Terms, our Privacy Policy, and our Referral Disclosure and your acknowledgment that you have reviewed them, and your continued use of the Site after any revision constitutes your acceptance of the revised Terms.

1. No Legal Advice or Attorney Client Relationship

The content on the Site is provided for general informational purposes only. It is not legal advice, does not constitute a legal opinion, and should not be relied on as a substitute for obtaining legal advice from a qualified attorney licensed in the applicable jurisdiction.

Your use of the Site, including sending us email, submitting a contact form, requesting a consultation, downloading materials, clicking third party links, or communicating with us through the Site, does not create an attorney client relationship between you and the Firm. An attorney client relationship is formed only through a signed written engagement agreement executed by the Firm and the client.

You should not send confidential, privileged, time sensitive, or otherwise sensitive information through the Site, any contact form, or unsolicited email unless and until we have confirmed in writing that no conflict exists and that we have agreed to represent you.

2. No Guarantee of Results

Any descriptions of prior matters, case studies, testimonials, endorsements, attorney profiles, representative results, verdicts, settlements, outcomes, referrals, or third party recommendations are provided for informational purposes only. Past results do not guarantee, predict, or imply a similar outcome in any current or future matter. Every legal matter is different and must be evaluated on its own facts and applicable law.

3. Attorney Advertising and Jurisdictional Compliance

The Site may be considered attorney advertising under applicable laws and professional conduct rules. The Firm does not seek to represent anyone based solely on a visit to the Site in a jurisdiction where the Site does not comply with applicable laws, ethics rules, or bar requirements.

The Firm's attorneys are licensed only in the jurisdictions identified in their individual biographies or as otherwise expressly stated on the Site. The Firm does not represent that attorneys are licensed in every jurisdiction from which the Site may be accessed.

4. Eligibility and Permitted Use

You may use the Site only for lawful purposes and in accordance with these Terms. By using the Site, you represent and warrant that you are at least 18 years old or otherwise of legal age to form a binding agreement in your jurisdiction; you will comply with all applicable laws, rules, and regulations in connection with your use of the Site; and all information you submit through the Site is true, accurate, and not misleading.

We grant you a limited, revocable, nonexclusive, nontransferable license to access and use the Site for your personal or internal business informational use only, subject to these Terms.

5. Prohibited Conduct

You will not use the Site in any way that violates applicable law or regulation; use the Site to harass, defame, threaten, abuse, stalk, or violate the rights of others; submit false, deceptive, unlawful, infringing, or misleading information; attempt to gain unauthorized access to any portion of the Site; interfere with or disrupt the integrity, performance, or security of the Site; introduce any virus, malware, or other harmful material; copy, scrape, reproduce, or exploit the Site or any Site content except as expressly permitted; use any robot, spider, or automated script to access the Site without prior written consent; use the Site to advertise or solicit without prior written consent; or impersonate any person or entity.

6. Intellectual Property Rights

The Site and all content, materials, text, graphics, logos, icons, images, audio, video, downloads, compilations, software, code, design elements, attorney biographies, blog posts, and other materials made available through the Site (collectively, "Content") are owned by the Firm, its licensors, or other content providers and are protected by copyright, trademark, trade secret, and other applicable intellectual property laws.

All rights not expressly granted in these Terms are reserved. Except for the limited license expressly granted above, no right, title, or interest in or to the Site or any Content is transferred to you.

Jacksonville Legal Team™, the Firm's name, logos, slogans, and related marks are trademarks or service marks of the Firm or its affiliates. You may not use any such marks without the Firm's prior written consent.

If you believe any Content on the Site infringes your copyright, you may submit a notice to [email protected] with sufficient detail to identify the allegedly infringing material and your claimed rights.

7. User Submissions

Any information, messages, inquiries, comments, documents, or other materials you submit to us through the Site (collectively, "Submissions") will be treated as nonconfidential and nonproprietary unless the Firm has expressly agreed otherwise in writing.

You represent and warrant that you have all rights necessary to provide any Submission and that your Submission does not violate any law or the rights of any third party. You grant the Firm a nonexclusive, worldwide, royalty free license to use, reproduce, transmit, store, and process Submissions to the extent reasonably necessary to respond to your inquiry, operate the Site, comply with law, enforce these Terms, facilitate requested referrals or third party services, or protect our rights. When you submit the contact form, your information may be stored in the Firm's customer relationship management system, and you may receive an automated confirmation email acknowledging receipt of your inquiry.

8. Privacy

Our collection, use, storage, and disclosure of personal information through the Site are governed by our Privacy Policy. By using the Site, you acknowledge that you have reviewed the Privacy Policy.

9. Third Party Links, Referrals, and Services

The Site may contain links to third party websites, platforms, service providers, referral partners, maps, payment processors, scheduling tools, social media services, financing providers, or other resources not owned or controlled by the Firm. We provide these links and references solely as a convenience and for general informational purposes.

In some cases, the Firm may receive a financial or other benefit if you click a third party link, submit information, apply for a service, complete a transaction, or otherwise interact with a referred third party. Such benefits may include referral fees, commissions, marketing fees, reciprocal referrals, discounted services, account credits, or other compensation or value, to the extent permitted by applicable law and professional obligations.

Any third party provider is independent from the Firm unless expressly stated otherwise in writing. A link, listing, mention, recommendation, or referral does not constitute a guarantee, certification, endorsement, warranty, or representation regarding a third party's qualifications, availability, pricing, products, services, legal compliance, suitability, or results.

We do not control and are not responsible for the content, policies, security, availability, acts, omissions, or practices of any third party website or service. Accessing or using any third party website or service is at your own risk and subject to that third party's own terms and policies.

10. Referral Tracking and Data Sharing

The Site may use referral links, cookies, pixels, tags, analytics tools, conversion tracking tools, call tracking tools, or similar technologies to track clicks, visits, inquiries, signups, conversions, or other activity relating to third party links or services. If you request, authorize, or knowingly pursue a referral or third party service through the Site, we may share information you provide, or information about your interaction with the Site, with the applicable third party provider or platform to facilitate your request, measure referral activity, administer business relationships, or operate the Site, in each case subject to our Privacy Policy and applicable law.

11. Text Messages, Calls, and Electronic Communications

If you provide your phone number, email address, or other contact information through the Site, you consent to receive communications from us relating to your inquiry, appointment scheduling, intake, referrals, and our services, subject to applicable law and our Privacy Policy. Consent to receive communications is not a condition of purchasing any goods or services.

If the Site offers SMS or text messaging functionality, additional terms may apply, including message and data rates, message frequency, carrier limitations, and opt out instructions. Marketing text messages, if any, will be sent only in accordance with applicable law.

We also send newsletters and other firm updates covering business law developments, firm news, and our services to the email addresses we receive. If you provide your email address through the Site, you may be added to that list. Each newsletter includes an unsubscribe link, and you may opt out at any time by using that link, by replying to any newsletter, or by contacting us at [email protected]. Opting out of newsletters does not affect communications relating to your inquiry or to an ongoing engagement.

12. Disclaimer of Warranties

THE SITE AND ALL CONTENT ARE PROVIDED ON AN "AS IS," "AS AVAILABLE," AND "WITH ALL FAULTS" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE FIRM DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NONINFRINGEMENT, ACCURACY, COMPLETENESS, AVAILABILITY, QUIET ENJOYMENT, AND FREEDOM FROM VIRUSES OR OTHER HARMFUL CODE. WITHOUT LIMITING THE FOREGOING, THE FIRM DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR FREE, SECURE, CURRENT, OR FREE OF OMISSIONS, OR THAT ANY DEFECTS WILL BE CORRECTED. YOUR USE OF THE SITE IS AT YOUR SOLE RISK. THE FIRM MAKES NO REPRESENTATION OR WARRANTY REGARDING ANY THIRD PARTY WEBSITE, PLATFORM, PROVIDER, PRODUCT, OR SERVICE REFERENCED, LINKED, OR MADE AVAILABLE THROUGH THE SITE.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE FIRM AND ITS AFFILIATES, PARTNERS, MEMBERS, ATTORNEYS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, PUNITIVE, OR ENHANCED DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS OPPORTUNITY, OR USE, ARISING OUT OF OR RELATING TO THE SITE, THE CONTENT, ANY THIRD PARTY SERVICES, ANY REFERRAL OR RECOMMENDATION, OR THESE TERMS, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE AGGREGATE LIABILITY OF THE FIRM AND ITS AFFILIATES ARISING OUT OF OR RELATING TO THE SITE, THESE TERMS, ANY THIRD PARTY SERVICES, OR ANY REFERRAL OR RECOMMENDATION WILL NOT EXCEED US$100. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS OR LIMITATIONS OF LIABILITY, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU TO THE EXTENT PROHIBITED BY LAW.

14. Indemnification

You will defend, indemnify, and hold harmless the Firm and its affiliates, partners, members, attorneys, employees, contractors, agents, licensors, and service providers from and against any claims, demands, actions, proceedings, damages, judgments, awards, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to your use of the Site; your breach of these Terms; your violation of applicable law; your infringement, misappropriation, or violation of any rights of any person or entity; or any Submission or information you provide through the Site.

15. California and Other Consumer Rights

If required by applicable law, certain users may have additional rights regarding personal information, website accessibility, or consumer protections. Nothing in these Terms is intended to waive rights that cannot be waived under applicable law.

16. Accessibility

The Firm seeks to maintain the Site in a manner intended to promote accessibility for users with disabilities. If you encounter an accessibility issue, please contact us at [email protected] or +1 (904) 780-0059 and provide a description of the issue so we can work to address it.

17. Modifications to the Site and Terms

We may modify, suspend, discontinue, or restrict access to all or any part of the Site at any time, with or without notice.

We may revise these Terms from time to time in our discretion. Updated Terms will be effective when posted to the Site unless a different effective date is stated. Your continued use of the Site after updated Terms are posted constitutes your acceptance of the revised Terms.

18. Termination

We may terminate or suspend your access to the Site, in whole or in part, immediately and without notice, for any reason or no reason, including if we believe you have violated these Terms, applicable law, or the rights of any third party. Upon termination, the rights granted to you under these Terms will immediately cease, and Sections that by their nature should survive termination will survive, including Sections relating to intellectual property, privacy, third party services, referral tracking, disclaimers, limitations of liability, indemnification, governing law, and miscellaneous provisions.

19. Governing Law and Venue

These Terms and any dispute arising out of or relating to these Terms or the Site will be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of laws principles. Any action or proceeding arising out of or relating to these Terms or the Site must be brought exclusively in the state or federal courts located in Duval County, Florida, and each party irrevocably submits to the personal jurisdiction of those courts and waives any objection based on inconvenient forum or improper venue.

20. Dispute Resolution and Mediation

Except as provided below, before commencing any action or proceeding arising out of or relating to these Terms or the Site, you and the Firm agree to attempt to resolve the dispute through good faith mediation. Mediation will be conducted by a mediator selected by the Firm and will take place by videoconference or at a location in Florida designated by the Firm. The Firm will identify the mediator it has selected and propose scheduling within a reasonable time after receiving written notice of the dispute.

The parties will share the mediator's fees and costs equally unless the mediator or the parties agree otherwise in writing, and each party will bear its own attorneys' fees and costs. Completion of mediation is a condition precedent to filing a court action, and any applicable limitations period is tolled while mediation is pending. Either party may seek temporary or injunctive relief in court without first mediating where necessary to prevent irreparable harm, preserve the status quo, or comply with an applicable deadline.

Nothing in this Section limits the Firm's obligations under applicable rules of professional conduct, requires you to mediate a matter that cannot lawfully be submitted to mediation, or waives any right that cannot be waived under applicable law. If mediation does not resolve the dispute, either party may pursue the dispute in the courts identified in Section 19.

21. Notice Regarding Time Sensitive Matters

The Site is not intended for the submission of time sensitive legal matters. You acknowledge that email, contact forms, chat features, and other Site communications may not be monitored continuously and may not receive immediate attention. Do not rely on the Site to meet deadlines, preserve claims, avoid statutes of limitation, or obtain emergency legal assistance. If your matter is urgent, do not use the Site alone. Instead, call emergency services, contact appropriate authorities, or seek immediate legal counsel through direct confirmed communication.

22. Miscellaneous

These Terms constitute the entire agreement between you and the Firm regarding the Site and supersede all prior or contemporaneous understandings relating to the Site.

If any provision of these Terms is held invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect, and the invalid, illegal, or unenforceable provision will be enforced to the maximum extent permitted by law.

The Firm's failure to enforce any provision of these Terms will not operate as a waiver of that provision or any other provision. You may not assign or transfer these Terms or any rights under these Terms without the Firm's prior written consent. The Firm may assign these Terms without restriction. Nothing in these Terms creates any partnership, joint venture, employment, agency, fiduciary, or other special relationship between you and the Firm except as expressly set out in a signed written engagement agreement. Section headings are for convenience only and do not affect interpretation.

23. Consultation and Screening Fees; Cancellation and Refunds

Certain services requested through or in connection with the Site are subject to a fee, including an initial consultation and any preliminary screening of a matter. The amount of each fee is disclosed at the time you book or request the service, and payment is processed by the third party scheduling or payment provider identified at that time. Payment of a consultation or screening fee does not create an attorney client relationship, is not a quote or estimate of the cost of legal representation, and is not credited against future legal fees unless the Firm states otherwise in writing.

A $50 cancellation fee applies to any cancellation made more than 48 hours before the scheduled consultation. The Firm reserves the right to refuse a refund of any portion of the fee where the cancellation is made within 48 hours of the scheduled consultation. Screening fees are nonrefundable. Requests to cancel or reschedule should be directed to the Firm at [email protected] or +1 (904) 780-0059 with as much advance notice as possible so the reserved time may be offered to another client.

Where the Firm cancels an appointment or is unable to hold it, the Firm will refund the amount paid for that appointment or offer an alternative time. If the cancellation terms stated in a booking confirmation you received differ from this Section, that confirmation controls, and any refund or credit required by applicable law is not limited by these Terms.
